These Terms of Service ("Terms") govern your use of Salon Ally's AI-powered salon management platform and related services. By using our service, you agree to these Terms.
1. Service Description
Salon Ally provides an AI-powered salon management platform that includes:
- AI-assisted communication management across SMS, phone calls, and email
- Appointment scheduling with salon-specific logic (processing time overlap, service combinations, stylist levels)
- Client relationship management with cross-channel conversation memory
- Call intelligence and coaching analysis
- Waitlist management with priority-based matching and automated outreach
- Action proposal and approval workflows where AI drafts and staff decide
- Register and point-of-sale functionality
- Dashboard, analytics, and business intelligence reporting
- Multi-tenant workspace management for single and multi-location operations
- Full audit trails on every system action
2. Account Terms
Workspace Owners
- You must provide accurate and complete business information
- You are responsible for maintaining account and workspace security
- You must be 18+ or have legal authority to enter contracts on behalf of your business
- Each salon location requires its own workspace; multi-location accounts are managed through the multi-tenant admin console
- You are responsible for all activity under your workspace, including actions taken by invited staff members
- You are responsible for the accuracy of client data entered into the system
Staff Members
- Access is granted through workspace invitations from the workspace owner
- Staff roles and permissions are managed by the workspace owner
- Each staff member must use their own credentials; sharing login information is prohibited
- Staff members may belong to multiple workspaces if invited
AI-Assisted Features
- AI features generate proposals and drafts that require human approval before execution
- You acknowledge that AI-generated content (response drafts, scheduling suggestions, coaching analysis) is advisory and should be reviewed before approval
- You are responsible for reviewing and approving all AI-proposed actions
- AI coaching scorecards and call analysis are tools for improvement, not guarantees of accuracy
3. Acceptable Use
You agree NOT to:
- Use the service for any illegal purpose
- Attempt to access other workspaces' data or circumvent tenant isolation
- Upload malicious code or interfere with the service
- Scrape, copy, or redistribute our platform or its content
- Misrepresent your identity, salon, or business
- Share login credentials with unauthorized parties
- Use the platform to spam, harass, or send unsolicited communications to clients
- Attempt to reverse-engineer AI models or extract training data
- Use the call intelligence features to record or analyze calls without proper consent under applicable law
4. Communication & Integration Responsibilities
- SMS/Phone: You are responsible for ensuring compliance with applicable telecommunications regulations (including TCPA, if applicable) for messages sent through the platform
- Email: You are responsible for configuring your IMAP/SMTP connections and ensuring compliance with applicable email regulations (including CAN-SPAM, if applicable)
- Call Recording: If your telephony provider records calls, you are responsible for obtaining any required consent under applicable state and federal laws
- Client Consent: You are responsible for informing clients that AI assists in processing their communications
5. Pricing & Payment
- Subscription: Monthly subscription based on selected plan and workspace size
- Billing: Charged monthly in advance
- Price Changes: 30 days notice for any price increases
- Refunds: 30-day money-back guarantee for new accounts
- Cancellation: Cancel anytime; access continues until end of billing period
- Non-Payment: Service may be suspended for overdue accounts; data retained for 90 days
- Multi-Location: Enterprise pricing is negotiated per agreement
30-Day Money-Back Guarantee: New customers can request a full refund within 30 days of initial signup if not satisfied with the service.
6. Intellectual Property
Our Content
- All platform features, design, AI models, and software are owned by Salon Ally
- You may not copy, modify, or redistribute our platform or its components
- AI-generated proposals and analysis are tools provided as part of the service
Your Content
- You retain ownership of your client data, business records, and configurations
- You grant us license to process your content as necessary to provide the service (including AI processing)
- You warrant that you have rights to all data uploaded to the platform
- You can export your data at any time
7. Data & Privacy
- We handle data according to our Privacy Policy
- Each workspace's data is isolated and not shared with other workspaces
- You own your salon's data and can export it anytime
- AI processing of your data is performed for service delivery only, not for model training
- We maintain regular backups but recommend keeping your own records
8. Service Availability
- We aim for 99.9% uptime but do not guarantee uninterrupted service
- Scheduled maintenance will be announced in advance when possible
- AI features depend on third-party model providers and may experience temporary degradation
- Communication integrations (SMS, phone, email) depend on your connected providers
- We are not liable for any downtime or data loss
- Force majeure events may affect service availability
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Our total liability is limited to the amount you paid in the last 12 months
- We are not liable for indirect, incidental, or consequential damages
- We are not liable for lost profits, lost business, or missed appointments
- We are not liable for actions taken based on AI-generated proposals that you approved
- We are not liable for communications sent after staff approval
- These limitations apply even if we knew damages were possible
10. Indemnification
You agree to indemnify and hold Salon Ally harmless from any claims arising from:
- Your violation of these Terms
- Your violation of any laws or regulations, including telecommunications and privacy laws
- Your use of the service, including approved AI proposals
- Content you upload or transmit through the service
- Disputes between you and your clients
- Failure to obtain required consents for communications or call recording
11. Termination
You May Terminate
- At any time by canceling your subscription
- By requesting workspace deletion
- You may export your data before termination
We May Terminate
- For violation of these Terms
- For non-payment
- If required by law
- With 30 days notice for any reason
After Termination
- Your access to the service ends immediately
- We will retain your data for 90 days to allow export, then delete unless legally required to retain
- Connected integrations (email, phone) will be disconnected
- AI processing of your communications will cease
12. Modifications to Terms
- We may update these Terms from time to time
- Material changes will be notified via email to workspace owners
- Continued use after changes constitutes acceptance
- You can always view the current Terms on our website
13. Governing Law
- These Terms are governed by the laws of Florida, USA
- Disputes will be resolved in the courts of Florida
- Both parties waive jury trial rights
14. Miscellaneous
- Entire Agreement: These Terms constitute the entire agreement
- Severability: Invalid provisions will be modified to be enforceable
- Waiver: No waiver unless in writing
- Assignment: You may not assign these Terms without our consent
